First identify what was recorded A complaint acknowledgement, general-diary entry, CSR-type receipt, non-cognizable report and FIR are not the same record. Names and systems vary by state. Read the receipt, note its number and use the police department's complaint or status channel first. Under Section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023, information relating to a cognizable offence may be given to the officer in charge of a police station, including by electronic communication subject to the statutory requirements. The legal remedies for refusal to record such information are separate from RTI. When RTI is useful Use RTI when you have an acknowledgement but cannot obtain a written account of what happened to the complaint. Address it to the PIO of the police unit or public authority that holds the complaint record. Request: The diary, CSR, NCR, petition or other number assigned to the complaint. Date on which it was received and the unit or officer to whom it was forwarded. Current recorded status and date-wise movement. Certified copy of any forwarding note, closure order, action-taken note or communication to the complainant, subject to lawful exemptions. The rule, standing order or procedure applicable to that category of complaint. The name and designation of the unit presently holding the complaint record. Copy-ready RTI wording To, The Public Information Officer, [Police Commissionerate / District Police / Police Department] Subject: Information regarding complaint acknowledgement [number] Under Section 6(1) of the RTI Act, 2005, please provide: 1. The diary/CSR/NCR/petition or other number assigned to my complaint dated [date]. 2. The date and unit/officer to whom the complaint was forwarded. 3. The current recorded status and date-wise movement of the complaint. 4. Certified copies of any forwarding note, closure order, action-taken note or communication issued to me, subject to the RTI Act. 5. The procedure applicable to this category of complaint, as available on record. 6. The name and designation of the unit presently holding the complaint record. Name, address, date and signature The limits of RTI RTI cannot compel registration of an FIR, direct an investigation, arrest a person or decide whether an offence occurred. Use the remedies provided under criminal-procedure law and obtain legal advice where necessary. Information may also be withheld where disclosure would impede an investigation under Section 8(1)(h) of the RTI Act. That exemption is applied to the requested information and circumstances; it should not be treated as an automatic reason to give no meaningful response at all. Avoid requesting witness identities, confidential sources, sensitive evidence or unrelated personal information.
